INFORMATION ON THE PROCESSING OF PERSONAL DATA

This document contains information about the principles of processing by BCLA Bisiorek, Cieśliński i Partnerzy Adwokaci i Radcowie Prawni (“BCLA”) of your personal data and about your rights related thereto in connection with the implementation of the requirements of the Regulation of the European Parliament and of the Council (EU) 2016/679 of April 27, 2016 on the protection of natural persons with regard to the processing of personal data and on the free movement of such data, and repealing Directive 95/46/EC (General Data Protection Regulation) (“GDPR”).

  1. Indication of the administrator

  2. Objectives and legal basis for the processing of your personal data
    1. BCLA shall process your personal data in connection with the conclusion of a contract by you with the BCLA or the taking of action by the BCLA at your request prior to the conclusion of a contract (Article 6(1)(b) of the GDPR).
    2. In addition, BCLA processes your personal data because it is necessary to comply with a legal obligation incumbent on the controller (Article 6(1)(c) of the GDPR) or when this is necessary to pursue BCLA’s legitimate interests (Article 6(1)(f) of the GDPR), in particular:
      1. for the purposes of fulfilling legal obligations under tax and accounting laws;
      2. for the purposes of litigation, as well as proceedings before public authorities and other proceedings, including the investigation and defense against claims;
      3. for the purposes of the sale of BCLA’s claims against you and the assertion of claims by BCLA;
      4. for the purposes of business development and marketing of legal services;
      5. for the purpose of answering your questions via email;
      6. for the purpose of researching web traffic on the site by analyzing anonymous data from web tags (cookies);
      7. for the purpose of recruiting individuals interested in working with BCLA (legal basis Article 6(1)(c) of the GDPR).
    3. In other cases, your personal data will be processed only on the basis of previously granted consent, to the extent and for the purpose specified in the content of the consent (Article 6(1)(a) of the GDPR).
  3. Information about the recipients of your personal data
    1. In connection with the processing of your personal data for the purposes indicated in para. 2, your personal data may be shared with the following recipients or categories of recipients:
      1. entities that cooperate with BCLA in the performance of contracts for your benefit, including entities that process data on the basis of Article 28 of the GDPR or Article 29 of the GDPR;
      2. public authorities and entities performing public tasks or acting on behalf of public authorities, to the extent and for the purposes that follow from the law,
      3. entities providing services for us (e.g. hosting, IT support);
      4. we may also share anonymous traffic data on our website (i.e. cookie analysis results) with our marketing agency.
  4. Periods of personal data processing
    1. Your personal data will be processed for the period necessary for the purposes indicated in Section’s 2 purposes, i.e. with respect to the conclusion and/or performance of the contract between you and BCLA, for the period until the conclusion or performance of the contract is completed, and thereafter for the period and to the extent required by generally applicable law and/or the regulations of the legal profession. To the extent that personal data will be processed for the purpose of directing marketing content to you, as referred to in Section 2.2.4, it will be processed until you withdraw your consent or object to such processing. We will keep the data obtained in correspondence for no longer than 5 years elapsing from the end of the year of their receipt, unless there is a specific reason for their further processing (e.g. provision of legal assistance). If the purpose of processing changes, we will inform you in accordance with the GDPR.
  5. Rights of data subjects whose data is processed
    1. BCLA informs you that you have the following rights:
      1. right to access and obtain a copy of your data;
      2. right to request rectification of your personal data;
      3. right to request deletion of your personal data;
      4. right to request restriction of personal data processing;
      5. right to portability of personal data;
      6. right to object to the processing of personal data;
      7. right to withdraw consent to the processing of personal data. Withdrawal of consent shall not affect the lawfulness of data processing carried out on the basis of consent before its withdrawal;
      8. right to lodge a complaint with the President of the Office for Personal Data Protection, in case of violation of the provisions of the GDPR in the processing of personal data.
    2. The indicated rights listed in sections 5.1.1-5.1.8 may be exercised by you by submitting a request to BCLA to exercise the right electronically to the following email address: kancelaria@bcla.pl or in writing to: 3 Olimpijska Street, 02-636 Warsaw.
  6. Information on the obligation to provide data
    1. Provision of personal data is a condition for the conclusion and performance of the contract with you. If you do not provide personal data, BCLA will be entitled to refuse to conclude a contract.
  7. Information on automated decision-making, including profiling
    1. BCLA does not process personal data for the purpose of making a decision that is based solely on automated processing, including profiling.
