Information clauses – BCLA personal data

  • Pursuant to art. 13 and 14 of the Regulation 2016/679 of the European Parliament and of the Council of 27 April 2016 on the protection of natural persons with regard to the processing of personal data and on the free movement of such data, and repealing Directive 95/46/EC (“GDPR”), information related to processing of personal data is provided below:

Data common for all information clauses on data processing

Data Controller

  • The Controller of your data is BCLA Bisiorek, Cieśliński i Wspólnicy sp.k., with its registered office in Warsaw and address: ul. Olimpijska 3, 02-636 Warszawa. Clause No. 1 for Clients

  • Your personal data will be protected and processed for the purposes of:
    • Performance of agreements pursuant to article 6 item 1 letter (b) GDPR,
    • performance of our legitimate interests consisting in possible establishment, exercise or defence of legal claims (legal basis for processing is article 6 item 1 letter (f) GPDR,
    • performance of legal obligations of BCLA, in particular tax and accounting provisions – legal basis of processing is article 6 item 1 letter (c) GPDR,
    • performance of our legitimate interests (article 6 item 1 letter (f) GDPR – our legitimate interest are handling of your requests, contacts with you, including contacts for the purposes related to the agreement.
  • Personal data are stored within the term of the agreement, but no longer than 6 years from the day of its completion. After this period data will be processed only in the scope and term required by provisions of law, including provisions of tax law and accounting law. Period of data processing may be extended by claims limitation period or defence against such claims by BCLA. Limitation period is established on the basis of a given claim and relevant provisions of law – maximum 6 years from the date of performing agreement depending on type and date of claim establishment.
  • The Recipients of your data will be external entities performing accounting services for BCLA, entities providing legal services for BCLA, entities dealing with processing of payments for BCLA (including banks), IT service providers, providers of IT systems, host, affiliates and companies related to BCLA.
  • You have the right to: access the content of your personal data, including demand for issuing their copy and demand for rectification, erasure (right to be forgotten), limitation of personal data processing and right to transfer personal data to another controller, right to object against processing of personal data. You have the right to appeal to the President of the Personal Data Protection Office if you consider that personal data are processed in breach of GDPR provisions.
  • Provision of personal data in connection with entering into agreement is voluntary, but it is necessary for entering into / settlement of agreement.

Clause No. 2 for the Clients’ employees, attorneys, management board members and shareholders/partners

  • Your data have been made available to BCLA by our Client/business partner whom you represent or whose employee/contractor you are, or have been obtained from public registers (e.g., register of business entities, court registers KRS/CEIDG [National Court Register/ Central Register of Business Activities]) in relation to BCLA’c performance of a commercial agreement between BCLA and the entity which you represent/ whose employee/contractor/shareholder/partner you are.
  • We will process the following categories of your personal data:
    • for representatives: name(s) and surname, function in the representation body, position, e-mail address, telephone number,
    • for other persons: name(s) and surname, e-mail address, telephone number, position.
  • BCLA will process your personal data where necessary for purposes resulting from legitimate interests pursued by BCLA or by a third party – pursuant to Article 6(1)(f) of the GDPR – whereas BCLA regards the following as legitimate interests: entering into and performing a commercial agreement between BCLA and the entity which you represent/ whose employee/contractor, and furthermore establishment, enforcement of and defence against claims.
  • The recipients of your personal data may be entities providing BCLA with services regarding the performance of the commercial agreement referred to in paragraph 1, including but not limited to IT, legal, accounting services, bodies authorised to receive your personal data under provisions of law.
  • Your personal data will be stored for a period necessary for entering into and performing the commercial agreement as referred to in paragraph 3. The storage period will be extended by the period of limitation of claims if the processing of your data is necessary for establishment or enforcement of any claims or defence against such claims by the Data Controller. After such periods, the data will be stored only for a period required by provisions of law.
  • You have the right to demand from BCLA access to, rectification, erasure or restriction of processing of your personal data, as well as data portability. If you do not want us to process your personal data, you can object to the processing of your personal data any time. You have the right to lodge a complaint with the President of the Office for Personal Data Protection.

Clause No. 3 for persons contacting BCLA

  • Your personal data will be protected and processed for the following purposes: taking actions before entering into an agreement under Article 6(1)(b) of the GDPR; handling your enquiry (Article 6(1)(f) of the GDPR) – it is our legitimate interest to inform about our commercial offer and to conduct negotiations, to register correspondence and to provide replies necessary for the purposes arising from legitimate interests of the data controller (Article 6(1)(f) of the GDPR) – complying with timely response to letters, taking care of the quality of cooperation with the business partners and with other interested parties.
  • Your personal data will be stored for the period of maintaining correspondence. After such a period, the data will be processed only to an extent and for a period required by provisions of law. The period of processing of personal data may be extended each time by the period of limitation of claims if the processing of your data is necessary for enforcement of any claims or defence against such claims by BCLA.
  • The recipients of your data may be: entities providing IT services to BCLA, e-mail hosting, accounting, postal services, suppliers of IT services, IT systems, e-mail hosing, entities providing legal services to BCLA.
  • You have the following rights: the right of access to the contents of the personal data, including the right to demand delivery of a copy of such data and to demand rectification of such data, erasure of personal data (the right to be forgotten), restriction of processing of the personal data, the right of portability of personal data to another controller, the right to object to the processing of personal data, including for direct marketing purposes. You have the right to lodge a complaint with the President of the Office for Personal Data Protection where you consider the processing of the personal data to be in breach of the provisions of the GDPR.
  • Providing your personal data in relation to entering into the agreement is voluntary, but it is necessary for maintaining the correspondence.

Clause No. 4 for persons contacting for the purpose of recruitment at BCLA

  • Your personal data will be processed for the following purposes:
    • for the purpose of carrying out the recruitment process – the legal basis is Article (6)(1)(b), and in respect of data which are not required by provisions of law – the legal basis for processing of the data is the consent under article 6(1)(a) of the GDPR,
    • for the purpose of carrying out future recruitment processes, if consent is given for the processing of the data for that purpose – the legal basis for processing of the data is the consent under Article 6(1)(a) of the GDPR,
    • for the purpose of establishment or enforcement of any claims or defence against claims by BCLA – the legal basis for processing is the legitimate interest of the Data Controller (Article 6(1)(f) of the GDPR) – the legitimate interest is enabling the protection of its rights.
  • Your personal data will be transferred to entities providing BCLA with services relating to carrying out the recruitment processes, suppliers of IT systems and IT services, post operators and couriers.
  • Your data will be processed until the recruitment process is completed, and if the processing is based on consent – until the consent is withdrawn, whereas if consent is given for the processing of data for the purposes of future recruitments, the data will be processed no longer than 12 months. The period of processing may be extended each time by the period of limitation of claims if the processing of your data is necessary for establishment or enforcement of any claims or defence against such claims by BCLA.
  • Each of the consents given may be withdrawn any time. The withdrawal of consent will not affect the lawfulness of processing before withdrawal of consent. For evidence purposes, please withdraw consents in writing or electronically.
  • You have the following rights: the right of access to the contents of the personal data, including the right to demand delivery of a copy of such data and to demand rectification of such data, erasure of personal data (the right to be forgotten), restriction of processing of the personal data, the right of portability of personal data to another controller, the right to object to the processing of personal data, as well as the right to lodge a complaint with the President of the Office for Personal Data Protection where you consider the processing of the personal data to be in breach of the provisions of the GDPR. You have the right to object to the processing of personal data on grounds relating to your particular situation. For evidence purposes, please lodge the objection in writing or electronically.
  • Providing personal data is required for the purpose of carrying out the recruitment. A refusal to provide data will result in an inability to consider you as a candidate in the recruitment process. As to personal data not required in the announcement, providing such data is voluntary.
